Houston, Texas Breath Tests in Jeopardy
Houston, Texas – Over 2600 DWI/DUI cases could be dismissed because of the recent indictment of a local breath test technical supervisor – the person who is hired by the Government to maintain the breath test machine.
The Harris County District Attorney’s office announced that Deatrice Wallace, a breath test technical supervisor, was charged and arrested for the felony offense of tampering with a government records related to the breath test machines. In recent years there have many questions regarding the accuracy of the breath test machines and if they truly accurately measure breath alcohol levels.
According to Texas DPS reports, Ms. Wallace was responsible for the machines located in Galveston, Friendswood, League City, South Houston, Pearland, Webster, Seabrook and Clute, Texas.
Many Houston DWI/DUI lawyers have openly questioned the breath test regulations and the accuracy of the machines used to convict drivers of DWI. This further calls into questions the validity of any breath test result.
