Houston DWI Police Officer Under Investigation

After being disciplined for insubordination, a Houston DWI police officer is in a fight for his job and his freedom after a criminal investigation.  According to an assitiant district attorney at the Harris County District Attorney's office, the officer's criminal case will be presented to a Grand Jury in March to determine if any criminal charges will be filed.

The attorneys at Johnson, Johnson & Baer, P.C. have suspected for some time that officers have, in effect, coerced persons charged with DWI into taking a Breath Test.  We have had many clients tell us that they were never read the proper paperwork before either giving a breath test or refusing to give a breath test.  This precise DWI / breath test issue is now being investigated.

It is unknown at this time how the attorneys for the Government are going to treat this officer as a witness.  It is certainly our hope that the DWI / DUI cases that the officer participated in investigating will be dismissed.  Unfortunately, we are not confident that this will happen.
