ADA's Quiet About Investigation of Houston DWI Officer ADA's Quiet About Investigation of Houston DWI Officer

Houston, Texas - The Harris County District Attorney's Office seems to be keeping the investigation into the wrongdoings of a Houston Police DWI Officer under wraps.

Despite rumors floating around the Harris County Courthouse, none of the assistant district attorneys seem to want to "let the cat out of the bag" about the ongoing investigation into the DWI officer's alleged criminal acts.  I have asked several of the attorneys in the office and have yet to get a response that amounted to any real information.  This DWI officer was involved in at least 7 of my current cases that are pending in Harris County. 

I have a duty to ask, and my clients have a duty to know if this officer is involved in some type of criminal activity.  If any information known to the Government is Brady material (and yes impeachment evidence is Brady material), the Government has an affirmative duty to inform defense counsel of that Brady information.  To date, I have not be informed of any Brady material with respect to these DWI cases.

It is my hope that a senior member of the Harris County District Attorney's office understands the obligations of the Government and educates some of the younger prosecutors of their duties to disclose this information in these DWI cases.
