Houston, Texas DWI No Refusal Weekends - Is Blood Test Admissible? Houston, Texas DWI No Refusal Weekends - Is Blood Test Admissible?

Houston, Texas - The Houston Police Department in conjuction with the Harris County District Attorney's Office and local Judge's and Magistrates have implemented a policy of "No Refusal Weekends." The real question in these DWI cases is, "Is the result of the blood test admissible in your trial?"

Just because the Government forces you to submit to the taking of a blood sample for analysis of alcohol concentration, does not mean the blood test results come into evidence in your DWI trial.  In fact, the burden is on the Government to show the Court how and why the blood test should be allowed into evidence.

Houston DWI Lawyers have had many successful challenges to keep the blood evidence out of trial.  Specific procedures must be followed in order to have the test results deemed admissible.  Additionally, the police are not allowed to put any pressure on a citizen to get consent for a blood test.
