Houston, Texas - After a lengthy hearing about the admissibility of a .24 Blood Test, a Harris County Judge determined the blood test to be inadmissible and the assistant district attorney dismissed the DWI.

A Houston, Texas DWI was dismissed after a hearing on the admissiblity of a .24 determined the police officers and medical personnel violated my client's rights. 

Client was charged with Driving While Intoxicated after she wrecked her vehicle and sustained injuries.  However, when medical personnel showed up on the scene to treat her, client refused any and all medical treatment - which she has every right to do.  While the police officer was there, the paramedics strapped her to a backboard and taped her to the backboard.  Client continued to refuse treatment, but upon arrival at the hospital, the hospital took her blood from her and analyzed the blood for alcohol. 

After her discharge from the hospital, the police with the assistance of the District Attorney's office issued a subpoena to obtain client's blood alcohol results from the hospital.  The hospital lab results indicated client's blood alcohol concentration was .24 - three times the legal limit.
