Houston Man Charged with Intoxication Manslaughter Killed by Suspected Drunk Driver Houston Man Charged with Intoxication Manslaughter Killed by Suspected Drunk Driver

Houston, Texas - A Pasadena citizen awaiting trial on Felony Murder charges was a passenger in a vehicle that was involved in a fatal collision that killed the man awaiting trial.

Harris County officials are investigating a one-car fatality accident and suspect the driver of drunk driving.  While the driver of the vehicle is unknown at this time, the passenger of the vehicle is Nicholas Hernandez.  Hernandez was awaiting trial on his own Intoxication Manslaughter charge when he was killed.  According to court records, Hernandez was charged with Felony Murder after he allegedly caused a double fatality head on collision in August of 2008.  According to the charging document, it is alleged that Hernandez had 2 prior convictions for Driving While Intoxicated (DWI).  The 3rd DWI in Texas is a felony and as a result, Hernandez was charged with Felony Murder.
