Houston, Texas - A Houston man is sleeping a little easier after his DWI case was thrown out by the Judge because the police did not have a valid reason to stop him.

Spinning tires alone is not enough to stop a citizen for a traffic violation.  Fortunately, after being given the case law on this issue, a Houston Judge found that the police violated my client's rights by stopping him for this reason.  The legislature made it clear, spinning tires (exhibition of acceleration) is only illegal if you are participating in a race.

After the Judge determined the police had violated my clients rights by illegally detaining him, then everything else was thrown out.  Among other things, the field sobriety tests were thrown out, the admission of drinking alcohol was thrown out, the breath test of 0.18 was thrown out, and the video in the case was thrown out.  The Driving While Intoxicated - DWI / DUI - was ultimately dismissed.
