Harris County .18 DWI Breath Test Suppressed - DWI Dismissed
After hearing testimony regarding our client's breath test, a Harris County Judge determined that the .18 breath test was not voluntary and suppressed the test. Pursuant to an agreement, the Government was forced to dismiss the DWI.

Ultimately, it was determined that the police officer informed client prior to him taking the breath test that if he passed the breath test, he would not be charged with Driving While Intoxicated - DWI. Client relied upon this statement and decided to take the breath test. Texas courts have determined a breath test with this type of promise is not voluntary.
