Another Trial Day .17 Breath Test Dismissal
Plolice officers stopped client for speeding. Upon speaking with client, Houston police officers smelled alcohol on his breath and began a DWI investigation. After having client step out of his vehicle, the officer conducted field sobriety tests.
Not surprisingly, the officer claims that our client failed the HGN test and the One Leg Stand test. Even according to the officer's report, however, the client only had 1 clue (non-intoxicated score) on the Walk and Turn test. In spite of this, the officer arrested client and transported him to the Houston Police Department for more tests.
Client agreed to give a breath test and that test registered .17 - over twice the legal limit. The case was dismissed today after it was discovered that the breath test operator (the person that gives the DWI breath tests) was not certified to give the test.
