Former District of Columbia Mayor Marion Barry is at it again - this time being charged and tried for Driving While Intoxicated, Operating a Vehicle While Impaired and driving a vehicle that is not registered.

Superior Court Judge R. Ringell indicated that the prosecutor did not present enough evidence to convince him Beyond a Reasonable Doubt that former Mayor Barry was in fact intoxicated while operating his vehicle.

Barry agreed to take a breath test after his arrest that showed he was under the legal limit at that time. The defense successfully argued that Barry’s age coupled with his medications for high blood pressure and diabetes were the reason for the arrest.
